This week, one of my professional disciplinary action clients received a letter from the investigator clearing him of the charges. A win. And he deserved it too. But the path to victory takes time. To accomplish this result, we had to thoroughly research the factual and legal issues, and then make some strategic choices about which arguments to highlight in response to the complaint. The client and I collaborated, and apparently we made good choices. The lesson here is that we did this work and analysis before responding to the complaint. Far too often, professionals submit a knee-jerk response to a disciplinary complaint without getting professional advice first. Poorly prepared and researched responses can lead to additional disciplinary proceedings, and worse, to the imposition of discipline itself. Please take disciplinary investigations and complaints very seriously. Hire an experienced attorney and put in the effort at the outset of the process.
