You’ve spent years climbing the corporate ladder, hitting targets and managing workloads. Then, a sudden meeting with HR changes everything. You are handed a Performance Improvement Plan (PIP) filled with vague goals and impossible deadlines.
In some Pennsylvania and New Jersey offices, a PIP isn’t always a coaching tool. Rather, it could be management attempting to fabricate a paper trail to support termination for an illegal reason.
Spotting the signs of a scripted exit
Suspicious timing is a big red flag when it comes to a PIP. For instance, did a plan appear shortly after you reported harassment or requested a medical accommodation? If your metrics were meeting expectations last quarter but are suddenly “failing” now, the company may be creating a pretext for your termination. Does your PIP makes work intolerable or hostile? If so, it could be an attempt to pressure you to resign.
This is a critical moment to observe how your treatment differs from colleagues in similar roles who are not being targeted.
Building your evidence while you still have access
You cannot rely on your memory alone when challenging a discriminatory PIP. You need a contemporaneous record of events to counter the company’s narrative before you lose access to your office files. You can do this by:
- Keeping a private log of every meeting, including who was present and what was specifically said
- Saving copies of positive performance reviews and emails from clients that contradict the plan’s claims
- Emailing your rebuttals to HR, clearly pointing out factual inaccuracies in the requirements
- Tracking your own performance, work tasks and hours in a separate place
These documents serve as the foundation for a potential retaliation or discrimination claim under the federal law or state laws like the Pennsylvania Human Relations Act.
Protecting your career before the final meeting
Many professionals wait until they are fired to seek legal counsel, but that can be too late to influence the outcome. Consulting an attorney while you are still employed allows you to navigate the PIP more strategically. You can address the underlying issues, whether they involve age, race, gender or disability discrimination, from a position of relative strength.
Facing a discriminatory PIP is stressful, but you do not have to accept a flawed narrative. By taking proactive steps today, you preserve your rights and ensure that your side of the story is documented.
